Terms of Service

1. Acceptance of Terms

By accessing or using the Thinkific platform and services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Services. These Terms apply to all users, including experts, academies, companies, and learners.

2. Description of Services

Thinkific provides an AI-powered learning commerce platform that enables you to create, deliver, market, and sell online courses, learning programs, and digital products. Our Services include course building tools, commerce features, analytics, AI-powered features, and related support services.

3. Account Registration

  • You must provide accurate, complete, and current registration information
  • You are responsible for maintaining the security of your account credentials
  • You must be at least 18 years old to create an account
  • One person or entity may not maintain more than one free account
  • You are responsible for all activity that occurs under your account

4. Your Content

You retain all ownership rights to the content you upload to Thinkific. By uploading content, you grant us a limited license to host, display, and distribute your content solely for the purpose of providing the Services. We do not use your content to train AI models.

5. Acceptable Use

You agree not to:

  • Use the Services for any unlawful purpose
  • Upload content that infringes on intellectual property rights
  • Transmit malware, viruses, or harmful code
  • Attempt to gain unauthorized access to our systems
  • Interfere with the proper functioning of the Services
  • Engage in any activity that is abusive, harassing, or deceptive

6. Payment Terms

  • Fees are billed in advance on a monthly or annual basis
  • All fees are non-refundable except as required by law or as stated in our refund policy
  • We reserve the right to modify pricing with 30 days' notice
  • Transaction fees through TCommerce are subject to separate payment processor terms
  • Free trials do not require a credit card and convert to paid plans only with explicit authorization

7. AI Features

Our AI-powered features, including Thinker AI, are provided as tools to assist in content creation and learner support. You are responsible for reviewing and verifying all AI-generated content before publishing. AI features are subject to our data isolation commitments — your content is never used to train third-party AI models.

8. Termination

Either party may terminate these Terms at any time. Upon termination, your right to use the Services ceases immediately. We will provide a reasonable period for you to export your data. We may suspend or terminate accounts that violate these Terms without prior notice.

9. Limitation of Liability

To the maximum extent permitted by law, Thinkific shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Services.

10. Governing Law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Vancouver, British Columbia.
